SUMEMEP, (TransMadura.com) – Yayasan Bantuan Hukum (YLBH) Madura mendatangi Komisi I DPRD Kabupaten Sumenep, Madura, Jawa Timur, Senin, 6/1/ 2019.
Polemik yang terjadi di ruang komisi 1 DPRD Sumenep pada hari senin menjadikan beberapa faktor politik yang tidak sehat apabila (SK) tidak dijadikan pembekuan karena nanti menyebabkan kerugian terhadap keuangan negara.
Ketua YLBH Madura Kurniadi meminta perlindungan ke DPRD untuk mengeluarkan rekomendasi penundaan pemberlakukan SK pengangkatan kepala desa.
SK Bupati pengangkatan lima Kepala Desa yang diminta untuk dikoreksi itu diantaranya, Kepala Desa Bula’an, Kecamatan Batuputih, Kepala Desa Meddelan Kecamatan Lenteng, Kepala Desa Kalimo’ok Kecamatan Kalianget dan SK Kepala Desa Matanair Kecamatan Rubaru.
Kata Kurniadi, lima desa tersebut sejak tahapan Pilkades serentak berjalan telah digugat ke PTUN. Gugatan itu dilakukan karena disinyalir cacat hukum. Meski begitu, lanjut Kurniadi, panitia tetap melanjutkan meski proses hukum belum selesai.
“Karena ini sudah terlanjur, tidak apa-apa dilantik, tapi kami minta mereka tidak boleh menjalankan tugas sebagai kepala desa hingga proses hukum selesai,” pintanya.
Jika kewenangan lima kades itu tetap diberikan, lanjut Kurniadi, maka berpotensi akan terjadi kerugian negara. “Lah kalau gugatan kami menang nanti, kan Bupati harus bayar, dan bayarnya itu tidak bisa memakai uang pribadi, melainkan harus pakek APBD,” jelasnya.
Selain itu, berpotensi terjadi kerugian negara, kata dia juga menjadi presiden buruk yang dilakukan oleh Pemerintah Daerah. “Pemerintah tidak mencerminkan cara berpolitik yang bagus dan tidak mencerminkan cara berprilaku sesuai hukum, karena bisa dianggap tidak taat hukum,” tegasnya.
Sementara itu Anggota Komisi I DPRD Sumenep Irwan Hayat mengaku belum bisa memberikan surat rekomendasi soal penundaan pemberlakukan SK lima Kades sebelum melakukan kajian diinternal Komisi I.
