Transmadura.com, Sumenep — Setelah melalui tahapan proses persidangan dalam kasus penyelewengan bantuan Beras Untuk Warga Miskin (Raskin) yang dilakukan ikbal Kepala Desa Guluk – Guluk, Kecamatan Guluk – Guluk, Sumenep, Majelis Hakim Tindak Pidana Korupsi (Tipikor ) Surabaya, menberikan vonis hukuman satu tahun penjara. Pada Tanggal 30/03/2017.
Kades Guluk – Guluk Ikbal dinyatakan dalam kasus penyelewengan Beras Miskin (Raskin) Majelis Hakim Tipikor Surabaya, menyatakan amar putusan tersangka kasus dugaan penyelewengan bantuan beras untuk masyarakat miskin (raskin) itu terbukti bersalah.
Menurut Kepala Kejaksaan Negri Sumenep, Bambang Sutrisna, mengatakan, Majelis Hakim Tipikor Surabaya memutuskan Vonis satu tahun penjara,
Vonis itu lebih ringan dari Jaksa Penuntut Umum (JPU) Kejaksaan Negeri (Kejari) Sumenep, yakni satu tahun enam bulan. Selain kurungan penjara, terdakwa juga dikenai denda sebesar Rp 50 juta subsider dua bulan penjara. Terdakwa juga harus mengganti kerugian negara sekitar Rp 253 juta.
Menurutnya, meskipun Majlis Hakim telah memutuskan Ikabal bersalah, namun Penuntut Umum Kejaksaan Negeri (Kejari) Sumenep belum bisa mengambil langkah selanjutnya. Karena Penuntut umum memiliki waktu selama tujuh hari untuk berfikir. ”Untuk vonisnya sudah dalam sidang beberapa waktu lalu,” katanya, Selasa, 11/04/ 2017.
Dikatakan, Jaksa Penuntut Umum (JPU) tetap akan menghormati semua keputusan yang dikeluarkan oleh majelis hakim, meskipun lebih rendah dari tuntutan penuntut umum. Karena Majelis hakim, memiliki kewenangan untuk menilai sesuai dengan fakta-fakta yang terungkap dalam persidangan. “Apalagi, putusan itu tidak terlalu jauh dari tuntutan sebelumnya,” ungkapnya.
Dalam persidangan Ikbal terbukti telah menyebabkan kerugian negara. Karena realisasi raskin tidak hanya diberikan kepada penerima yang terdaftar dalam Daftar Penerima Manfaat (DPM), melainkan juga diberikan kepada warga di luar daftar tersebut.
Bahkan dikatakan, hasil penyelidikan, menemukan fakta bahwa warga tergolong mampu dan aparat desa masih mendapat bagian.
Berdasarkan hasil audit BPKP, tindakan itu telah mengakibatkan kerugian sekitar Rp 253 juta. “Untuk uang pengembalian telah dibayar. Sehingga negara tidak dirugikan dan terdakwa masi dihukum. Ini kan cukup adil,” tegasnya. (Asm/hy)
