Polemik Status Antara Masjid Jamik Sumenep dan Masjid Agung

SUMENEP, (Transmadura.com) – Masjid Jamik Sumenep adalah masjid tertua sejak peninggalan semasa kerajaan tempo dulu. Pasalnya akhir akhir ini masjid Jamik menjadi perhatian sebagian pihak pertanyakan keberadaan status Masjid terbesar yang ada di ujung timur pulau Madura.

Namun, hal itu muncul dari yang mengatasnamakan FMSP (Forum Masyarakat Sumenep Peduli) pertanyakan status pengelolaan Masjid Jamik tersebut.

Beredar, FMSP melakukan Audiensinya bersama Bagian Hukum Setdakab Sumenep melakukan permohonan pengujian legalitas kepemilikan dan pengelolaan Masjid Agung yang di prakarsai Nurahmat, selaku Ketua FMSP pada Rabu, (30/11/2022) lalu.

“Perlu kita ketahui, bahwasanya Masjid Agung Sumenep telah ditetapkan sebagai situs Cagar Budaya yang disahkan pada tahun 2018. Jadi segala sesuatunya harus jelas,” kata Nurrahmad saat audiensinya yang diunggah salah satu media online.

Nurrahmad mempertanyakan tentang pengangkatan Takmir Masjid Jamik dan pendapatan yang selama ini diterima dengan perolehan uang parkir untuk dipertanggungjawabkan kepada siapa?

“Karena kita ketahui bersama bahwa biaya air, listrik dan pembangunan lainnya dibayari oleh Pemerintah Kabupaten Sumenep,” Ujarnya.

Dirinya menyatakan, bahwa berdasarkan Undang-Undang Cagar Budaya Nomor 11 Tahun 2010 Pasal 12 ayat 4 kepemilikannya dapat diambil alih oleh Negara apabila Pemilik Cagar Budaya, dan/atau situs Cagar Budaya tidak ada ahli warisnya.

“Atau tidak menyerahkannya kepada orang lain berdasarkan wasiat, hibah, atau hadiah setelah pemiliknya meninggal. Diatur juga di Perda Kabupaten Sumenep Nomor 6 Tahun 2014 tentang Pelestarian Cagar Budaya,” tegasnya.

Hal itu ditepis oleh pengurus Takmir Masjid Jamik Sumenep Wakil Ketua IV Bidang Hukum,
Ach supyadi, SH., MH, bahwa Nurahmad itu masih belum paham soal masjid Jamik, dirinya meminta untuk lebih mempelajari tentang aturan yang ada.

“Sebaiknya belajar soal aturannya dulu sebelum bicara, dari pada banyak bicara tapi terlihat banyak salahnya kan malu ke masyarakat,” ungkap Supyadi yang juga berprofesi pengacara.

Pihaknya menjelaskan soal masjid Jamik yang sangat berbeda dengan Masjid Agung. “kalau Masjid Agung itu boleh saja diatur oleh pemerintah, sementara yang ada di Sumenep itu Masjid Jamik, bukan Masjid Agung,” jelas Supyadi.

Sehingga, pihaknya menjelaskan kalau Masjid Jamik itu sudah jelas aturannya yang ada pada 1. Undang-Undang No. 11 Tahun 2010 Tentang Cagar Budaya. 2. Perda Kabupaten Sumenep No. 06/2014 Tentang Pelestarian Cagar Budaya dan 3.Keputusan Bupati Sumenep No. 188/437/KEP/435.012/2018 Penetapan Masjid Jamik Sebagai Cagar Budaya (Tingkat Kabupaten).

Sehingga, Masjid Jamik Sumenep merupakan cagar budaya yang sudah ada aturannya dari undang-undang sampai dengan keputusan Bupati sendiri, tidak boleh ada yang merubah baik bentuknya maupun dari nama cagar budaya itu sendiri.

“Siapapun itu termasuk juga pemerintah kabupaten atau bupati sendiri, tidak boleh ada yang intervensi, karena jika sampai ada yang intervensi dan merubah baik bentuk maupun namanya serta yang lainnya maka jelas itu melanggar undang-undang, melanggar Perda Kabupaten Sumenep dan juga melanggar Keputusan Bupati Sumenep sendiri,” tutupnya.
