DPRD Keluarkan Rekomendasi Pilkades Poteran Dinilai Prematur, LSM TOPAN Menyoal

SUMENEP, (TransMadura.com) – Pimpinan DPRD Kabupaten Sumenep, Madura, Jawa Timur mengeluarkan surat rekomendasi penundaan pelaksanaan Pemilihan Kepala Desa (Pilkades) Poteran, Kecamatan Talango, Sumenep Madura, Jawa Timur.

Surat yang ditandatangi oleh Ketua DPRD Sumenep H. Abdul Hamid Ali Munir, SH tertanggal 18 November 2021, itu diterbitkan berdasarkan hasil rapat internal berkenaan Pilkades Poteran, Sumenep.

Dalam surat tersebut berisi empat poin, salah satunya tentang Putusan Pengadilan Tata Usaha Negara Surabaya Nomor : 80/G/2021/PTUN.SBY, tanggal 8 September 2021, juncto putusan Nomor : 221/B/2021/PTUN.SBY, tanggal 9 November 2021 dan merekomendasikan agar Pemilihan Kepala Desa Desa Poteran agar ditunda selambat-lambatnya 15 hari setelah Surat Rekomendasi Komisi I ini diterbitkan.

Tri Ahmad selaku sekjen LSM TOPAN menyayangkan dikeluarkannya rekomendasi tersebut. Dimana surat yang di tujukan kepada bupati Sumenep tersebut terkesan dipaksakan dan sangat janggal.

“Apa dasar hukum dari dikeluarkannya rekom komisi I tersebut, jika putusan PTUN jo PTTUN itu masih prematur. Karena suatu putusan baru bisa di laksanakan setelah adanya penetapan eksekusi. Dan putusan perkara antara Suparman dan panitia Pilkades tersebut masih masih bisa di ajukan PK “ini ada apa ?? Apakah ada kepentingan politik atau komisi 1 tidak memahami hukum yang berlaku” katanya.

Mestinya kata Tri panggilan akrabnya, di DPRD melakukan kajian sebelum mengeluarkan surat rekomendasi. Apalagi, rapat yang dilaksanakan di Komisi I tanpa dihadiri ketua Komisi.

“Kenapa ketua DPRD terkesan di kejar waktu dalam mengeluarkan rekom, yang hanya berdasarkan rapat Komisi I yang tidak di hadiri ketua, dan ketua DPRD Sumenep dalam konsideran suratnya, berdasarkan ketua yang seharusnya bertindak atas nama pimpinan yang artinya sudah koordinasikan dengan pinpinan DPRD lainnya. Di mana surat ini di buat tanpa melalui pembahasan dengan pimpinan lainnya juga,” jelas dia.

Dimana surat tertanggal 18 November tersebut
“Dalam konsideran, tertulis “menerangkan : bahwa….kami ketua DPRD / bukan pimpinan”. Pertanyaannya apakah ini surat pribadi atau lembaga negara,” tegasnya.

Oleh sebab itu, pihaknya menduga ada indikasi mufakat jahat (Tipikor) atau setidaknya pelanggaran etik di DPRD Sumenep. “Hal ini selaras dengan dugaan atas apa yang di lakukan oleh panitia Pilkades Poteran dan Suparman, sebagaimana pengaduan LSM Topan yang saat ini dalam proses lidik oleh Unit Pidek Polres Sumenep,” tegasnya.
