Tambang Galian C Tak Berijin di Sumenep Potensi Kerugian Negara

SUMENEP, (TransMadura.com) –
Maraknya tambang urugan galian C di Kabupaten Sumenep, Madura, Jawa Timur, dapat sorotan. Pasalnya, tambang galian C di ujung timur pulau Madura ini, disinyalir tidak berijin dan ada dugaan kerugian kepada negara.

Hal itu disampaikan, Ketua Forum Rakyat Pembela Keadilan dan Orang-orang Tertindas (LBH-FORKOT) Sumenep, Herman Wahyudi, SH, Bahwa tambang ilegal di Sumenep secara otomatis merugikan negara jika tambang galian C tanah milik negara.

“Ini otomatis banyak kerugian negara, sudah lama beroperasi, apakah tambang itu ada kontribusi kepada negara,” ungkapnya.

Dirinya memastikan, jika tambang beroperasi tidak berijin apalagi di tanah negara, jelas sudah merugikan negara.

Sebab, semua mengambil aset negara untuk kepentingan pribadi. Sehingga semua itu masuk ranah tindak pidana korupsi (Tipikor)/ penyalahgunaan.”ini sudah masuk Tipikor tambang galian C di aset negara,” katanya.

Selain itu, kata Wahyudi, kerugian potensi pajak yang seharusnya di bayarkan kepada Negara menjadi Nol, seab proses dan eksistensi penambang ilegal, ini juga masuk kerugian.

“Tentu kerugian ekologis dan kerusakan lingkungan,” ucap Ketua LBH ini.

Sehingga, pihaknya meminta harus ada tindak lanjut oleh pihak pemerintah dan Aparat Penegak Hukum (APH). “Kami akan siap mengawal dan melaporkan kepada penegak hukum.

“Ini bukan hanya soal Ijin Usaha Galian C, tapi sudah masuk ranah Tipikor, pajak dan dampak ekologis yang massif,” tegasnya.

Kepala Bappeda Kabupaten Sumenep, Yayak Wahyudi, mengatakan, bahwa dalam RTRW tidak tercantum tambang urukan.

“Daerah khususnya di RT RW tidak ada petunjuk atau kalimat tambang urukan, sebab RT RW itu yang menjadi rujukan. “Kalau daerah urukan itu tidak ada kalimat urukan,” ujar Yayak saat dikonfirmasi di ruang kerjanya, Selasa, (16/3/2021).

Ditanya tentang legalitas dan kerugian negara?, Yayak mengaku, belum ada cantolan hukumnya. “Dasar hukumnya dari apa, persoalan legalitas bisa koordinasi dengan yang punya kewenangan,” ujarnya.

Sehingga, dirinya menyatakan dilema, sebab tidak punya kewenangan , karena semua itu ada di provinsi. “Kita mau mengobrak tidak bisa bukan kewenangannya, mau menikmati untuk PAD juga tidak bisa,” tuturnya.

Namun, pembelian timbunan kepada pihak penambang galian C, bagi para pelaku proyek (kontraktor) selama ini, yayak menyatakan secara kucing kucingan yang tetjadi. “saya belum tau persis apakah ada persyaratan harus yang berijin saya belum tau. kalau itu menjadi persyaratan harus yang berijin, saya kira tidak ada pembangunan,” tutupnya.
