Kasus tidak pidana penganiayaan dialami Fitrianingsih yang telah dilakukan proses penyidikan oleh Polsek Giligenting, Kabupaten Sumenep, Madura, Jawa Timur diduga tidak profesional.
“Penyidik dalam memproses kasus yang terjadi pada minggu, (9/2/2020) diduga ada main mata,” kata Saprawi, Kuasa Hukum Korban.
Indikasinya, lanjut Safrawi, penerapan pasal kepada JMT terduga pelaku tidak sesuai dengan hukum pidana. “Pasal yang dipakai adalah Pasal 352 KUHP, sehingga nantinya masuk kategori kasus ringan atau tipiring,” ungkapnya.
Padahal kata dia, akibat tindakan JMT menyebabkan korban mengalami luka dibagian muka. “Harusnya keadilan bagi korban diperhatikan, jangan kemudian meski secara fisik bisa beraktifitas lalu dianggap tidak terganggu secara psikis. Penyidik harus profesional dalam bekerja dan mengedepankan hati nurani,” jelasnya.
Selain itu kata dia, Polsek Giligenting terkesan menyembunyikan kasus tersebut. Saat dikonfirmasi, pihak Polsek mengaku berkas perkara telah dilimpahkan kepada Pengadilan Negeri (PN) Sumenep. Namun, setelah dikonfirmasi di PN, berkas perkara penganiayaan itu belum masuk.
“Setelah kami konfirmasi lagi, malah pihak Polsek mengaku masih memanggil saksi-saksi untuk melengkapi berkas perkara. Ini kan aneh, dan menunjukkan penanganan perkara sudah tidak profesional,” tuturnya.
Sayangnya Kapolsek Giligenting AKP Agus Haryadi Prihanto belum bisa dikonfirmasi. Saat dihubungi melalui sambungan telepon selularnya tidak merespon meski nada sambungnya terdengar aktif.
