Tak Terima Sebutan Ketua Kartar, Kuasa Hukum Dipolisikan, Ach Supyadi: Apa Salahnya?

SUMENEP, (Transmadura.com) – Ketua Karang Taruna (Kartar) Kabupaten Sumenep, Madura, Jawa Timur Nurahmad melaporkan Kuasa Hukum Masjid Jamik, ke Polres setempat. Kamis (15/12/2022).

Pasalnya, Kuasa Hukum Masjid Jamik diduga telah melakukan tindak pidana pencemaran nama baik soal rentetan audiensi disinyalir ada sebutan Ketua Kartar.

Sesuai tanda bukti laporan Polisi dengan nomor TBL/B/320/XII/2022/SPKT/Polres Sumenep/Polda Jawa Timur tertanggal 15 Desember 2022,

Nurahmad warga jalan Diponegoro Desa Karang Duak, Kecamatan Kota Sumenep mengatasnamakan Kartar datang ke kantor baju cokelat melaporkan Kuasa Hukum Masjid Jamik, yakni Ach Supyadi, SH, MH karena diduga melakukan
tindak pidana pencemaran nama baik melalui media online.

Nurahmad selaku pelapor mengatakan dan menyebarkan jika laporan itu sudah keluar LP terkait masalah pemberitaan di salah satu media online.

“Masalah saat aundiensi status kepemilikan dan pengelolaan masjid Jamik ada sebutan ketua karang taruna. Padahal saat itu saya tidak mengatasnamakan ketua Kartar, melainkan mengatasnamakan Forum masyarakat Sumenep Peduli,” kata Nurahmad saat dikonfirmasi melalui sambungan telepon selulernya.

Namun, lanjut Nurahmad, dalam pemberitaan tersebut salah satu oknum pengacara, yakni Ach Supyadi, SH, MH menyampaikan dirinya sebagai ketua karang taruna.

“Saat audiensi saya tidak pernah mengatasnamakan ketua karang taruna, sehingga saya diminta teman teman Kartar untuk menyikapi dan akhirnya sekira jam 15 :30 wib saya datang buat laporan ke polres,” ungkapnya.

Sehingga, dirinya menyatakan menyerahkan sepenuhnya kepada semua penyidik dan kalau tidak masuk otomatis penyidik menolak intinya laporan itu atasnama karang taruna. “Laporan ini hanya bentuk klarifikasi,” jelasnya.

Sementara, terlapor Kuasa Hukum Masjid Jamik, Ach Supayadi, SH, MH angkat suara dengan adanya dirinya dilaporkan atas pencemaran nama baik.

“Saya bertindak sebagai kuasa hukum masjid Jamik Sumenep, kalau kuasa hukum dilaporkan berarti yang bersangkutan tidak mengerti tentang pasal 16 UU 18 2003 tentang profesi advokat,” ujar Supyadi.

Padahal, kata Supyadi dalam pasal undang undang berbunyi bahwa advokat tidak bisa dilaporkan ketika melaksanakan tugas tupoksinya dengan baik, dilaporkan perdata maupun pidana walaupun Itu diluar pengadilan.

“Yang sangat disayangkan laporan tersebut sepihak, tidak melakukan klarifikasi atau tanya kebenaran berita tersebut. yang dijadikan dasar laporan adalah berita andaikan tanya kebenaran dia bisa memahami . Kalau pelapor bilang ada sebutan saat audiensi ketua Kartar tidak benar itu,” dalihnya.

Sehingga, pihaknya menyatakan Kalaupun diberita ada sebutan Ketua Kartar, itu produk jurnalistik dan pelapor tidak bisa mengatur jurnalistik. “Kalaupun saya menyebut ketua Kartar, apa salahnya kalau memang ketua Kartar melekat pada dirinya,” ucapnya.

Dengan demikian, pihaknya dengan tegas menyatakan sikap, sebab terlapor melaporkan terlalu jauh saya akan menyikapi dan dipastikan penyidik akan menghentikan karena karena buktinya tidak masuk. “Ketika dihentikan pasti saya akan laporkan balik, itu pasti saya kawal sampai ke pengadilan,” tutup Supyadi.
