Gugatan kedua Moh. Rasyidi dalam kasus sengketa tanah di Desa Pragaan Daya, Kecamatan Pragaan oleh Pengadilan Negeri (PN) Sumenep tetap dikenakan tergugat.
Pasalnya, pengadilan negeri setempat memutuskan kembali dimenangkan tergugat Ach. Munarah dkk, dalam sengketa tanah miliknya
“Sudah diputus dan perkara sengketa tanah itu kembali dimenangkan klien kami,” kata Syafrawi, dan Shahibul Arifin selaku kuasa hukum Ach. Munarah Dkk.
Putusan ini, kata Syafrawi, merupakan gugatan yang kedua kalinya. Dalam putusan PN Sumenep dengan Nomor perkara 10/Pdt.G/2021/PN.Smp. tertanggal 21 Oktober 2021 Majelis Hakim menolak atau gugatan yang diajukan oleh Moh. Rasyidi melalui kuasa Hukumnya Ach. Rifa’ie dan Achmad Agung dinyatakan tidak diterima (NO).
“Dengan begitu, sengketa tersebut dimenangkan oleh Ach. Munara dkk selaku tergugat,” ungkapnya.
Namun, menurut Syafrawi, selang beberapa waktu kemudian, penggugat kembali melayangkan gugatan yang kedua dengan nomor Perkara 20/Pdt.G/2021/PN.Smp dengan obyek dan pokok perkara yang sama. Namun, gugatan tersebut kembali dimenangkan oleh Munarah dkk.
Sesuai jadwal kata Syafrawi, sidang putusan digelar hari ini Selasa, (29/3/2022) di Pengadilan Sumenep. Kedua belah pihak didampingi kuasa hukum saat itu sama-sama datang di PN Sumenep untuk mengikuti sidang putusan itu. Namun karena terdapat beberapa faktor, sidang putusan digelar secara e-Court.
Dalam putusan tersebut Majelis Hakim menolak seluruh eksepsi tergugat, dan dalam pokok perkara tersebut Majelis Hakim juga menolak gugatan Penggugat untuk seluruhnya, dan menghukum Penggugat untuk membayar biaya perkara yang timbul dalam perkara ini yang hingga diperhitungkan sebesar Rp2.365.000,-.
“Putusan Majelis Hakim dalam perkara ini sudah tepat, karena kami yakin putusan itu berdasarkan bukti-bukti surat atau keterangan saksi sejak awal hingga akhir persidangan,” tukasnya.
