Tambang Ilegal Galian C di Sumenep Berujung Laporan, Pemkab Diminta Bertindak Tegas

Maraknya tambang Galian C (Batuan) ilegal (Tampa mengantongi ijin) di Kabupaten Sumenep, terus menggelinding ke penegak hukum. Pasalnya, galian c yang ditambang secara liar berdampak kepada kerusakan lingkungan dan sangat merugikan negara.

“Pemerintah Kabupaten Sumenep sudah jelas tidak pernah memberikan rekomendasi kepada ijin tambang Galian C (Batuan) sesuai UU No 4 Tahn 1999, yang otomatis ini adalah tak berijin alias ilegal,” kata Bagus Junaidi, Laskar Anti Korupsi (Laki) Jatim kepada media ini.

Sehingga, dirinya memastikan maraknya tambang liar itu, sangat berdampak kepada ekologis yang luar biasa.

“Tambang tak berijin ini sangat merugikan karena dampak kerusakan ekologisnya yang luar biasa. Sehingga potensi pemasukan ke Negara lewat pajak menjadi tidak ada,” ujarnya.

Aktivis senior ini, meminta pemkab bertindak tegas terhadap pelaku tambang ilegal itu, yang berpotensi merusak lingkungan dan juga berdampak terhadap ekologis potensi wisata alam.

“Kami meminta kepada Pemkab Untuk menindak tegas pelaku tambang ilegal itu, dan kami akan segera melaporkan maraknya tabang ilegal ini ke pihak terkait, utamanya Pemrov dan Pemerintah Pusat” ungkapnya.

Selain itu, pihaknya secara tegas, menyatakan akan melaporkan tidak pidananya sesuai Pasal 158 UU No 4 Tahun 1999 tentang Pertambangan dan batubara dengan ancaman 10 Tahun Penjara dan denda 10 Milyar Rupiah.

“Secara pidana kami akan proses pelaporan ke Polda Jatim sesuai Psl 158 UU No 4 Tahun 1999 tentang Pertambangan dan batubara,” tegasnya

Sementara itu, Edy biasa panggilan akrabnya menjelaskan, wilayah potensi tambang galian c ilegal yang belum mengantongi ijin dan dilakukan secara membabi buta, yakni Kecamatan Batuan, Desa Kebon Agung, Kecamatan Rubaru, Kecamatan Batuputih, dan Kecamatan Gapura.

“Wilayah ini yang berpotensi penambangan secara membabi buta, tidak memikirkan dampak dampak lingkungan. Apalagi potensi wisata Goa Jeruk, akan lenyap keindahannya ketika sudah dirusak tambang galian c secara liar,” ucap Bagus Junaidi.

Secara terpisah, Kepala Bappeda Kabupaten Sumenep, Yayak Wahyudi, menyatan, dalam RTRW tidak tercantum tambang urukan.

“Daerah khususnya di RT RW tidak ada petunjuk atau kalimat tambang urukan, sebab RT RW itu yang menjadi rujukan. “Kalau daerah urukan itu tidak ada kalimat urukan,” ujar Yayak saat dikonfirmasi di ruang kerjanya, Selasa, (16/3/2021).

Ditanya tentang legalitas dan kerugian negara?, Yayak mengaku, belum ada cantolan hukumnya. “Dasar hukumnya dari apa, persoalan legalitas bisa koordinasi dengan yang punya kewenangan,” ujarnya.

Sehingga, dirinya menyatakan dilema, sebab tidak punya kewenangan , karena semua itu ada di provinsi. “Kita mau mengobrak tidak bisa bukan kewenangannya, mau menikmati untuk PAD juga tidak bisa,” tuturnya.

Namun, pembelian timbunan kepada pihak penambang galian C, bagi para pelaku proyek (kontraktor) selama ini, yayak menyatakan secara kucing kucingan yang terjadi.

“Saya belum tau persis apakah ada persyaratan harus yang berijin saya belum tau. kalau itu menjadi persyaratan harus yang berijin, saya kira tidak ada pembangunan,” tutupnya.
