SUMENEP, (TransMadura.com) – Potensi gugatan hasil pemilihan Kepala Daerah (Pilkada) Sumenep, Madura, Jawa Timur untuk ke Mahkamah Konstitusi (MK) diprediksi kecil. Pasalnya, selisih perolehan suara antara pasangan calon (paslon) sekitar 3 persen lebih.
Sementara syarat pengajuan gugatan ke MK, selisih paling banyak 1 persen bagi jumlah penduduk 500 hingga 1 juta orang. Sehingga, untuk Kabupaten ujung Timur Pulau Madura ini dimungkinkan tidak bisa diajukan karena penduduknya 1 juta dan selisihnya mencapai hingga 3 persen. Maka, bisa jadi hasilnya akan mengikat.
Untuk diketahui, sesuai syarat pengajuan ke MK, apabila jumlah penduduk 250 ribu jiwa maka selisih paling banyak 2 persen, dan untuk 250 hingga 500 jiwa maka selisih paling banyak 1,5 persen dari total suara sah. Sementara 500 hingga 1 juta jiwa selisihpaling banyak 1 persen, dan untuk 1 jiwa lebih, maka selisih paling banyak 0,5 persen.
“Jika mengacu kepada hasil rekap kecamatan dan Quick count antara paslon Achmad Fauzi- Nyai Eva dan Fattah Jasin – Ali Fikri ada selisih 3,3 persen. Maka, untuk digugat ke MK serasa sangat kecil,” katanya Moh. Siddik, Pemerhati Hukum Sumenep.
Sebab, sambung dia, Sumenep berada dikisaran 500 hingga 1 juta jiwa, maka selisih paling banyak seharusnya 1 persen. “Dengan selisih 3 persen, maka potensi untuk adanya gugatan tentu saja sudah sangat kecil. Ini jika mengacu kepada persyaratan yang berlaku,” ungkapnya dengan serius.
Untuk itu, pihaknya meminta untuk legawa saja dengan perolehan hasil pilkada ini. Sehingga, tidak akan menguras energi.
“legawa saja, dan nanti bisa bertarung kembali pada Pilkada berikutnya. Daripada nanti mengajukan gugatan, tapi malah ditolak. Tentu, menjadi sangat tidak elok,” tutur pria yang juga berprofesi sebagai Advokat ini.
Siddik berharap semua elemen warga nantinya bisa menerima dan puas dengan hasil putusan KPU usai rekapitulasi tingkat Kabupaten. “Sebenarnya dari hasil kecamatan dan Sirekap sudah diketahui perolehan suaranya, sepertinya selisi sudah di atas 1 persen,” pungkasnya.
