SUMENEP, (TransMadura.com) — Banyaknya perkara Pidana Pemilu 2019 yang tidak diproses oleh Badan Pengawas Pemilu (Bawaslu) Sumenep, mendapat respon negatif dari masyarakat. Bahkan disarankan apabila ada yang tidak puas atas kinerja Komisioner Bawaslu untuk melaporkan ke Dewan Kehormatan Penyelenggara Pemilu (DKPP).
“Karena Komisioner Bawaslu bekerja dibawah aturan dan undang-undang, maka apabila ada yang tidak puas atas kinerjanya, bisa melaporkan ke DKPP,” kata Syafrawi, Pengamat Hukum asal Sumenep, Selasa,
Dikatakan, berdasarkan hasil amatannya kinerja Bawaslu saat ini banyak dikeluhkan. Indikasinya selama dua hari masyarakat melakukan protes dengan cara melakukan aksi demo di Kantor Bawaslu Sumenep.
Sebab, kata dia banyak persoalan yang terkesan tidak diproses secara profesional. Buktinya lanjut Syafrawi, rata-rata perkara pidana Pemilu dihentikan, bahkan ada yang disingalir diputus secara tidak prosedural.
“Ada perkara pemilu yang dihentikan dengan alasan ne bis in idem. Sesuai aturan, keputusan itu hanya bisa dikeluarkan apabila ada putusan Majelis Hakim, dan itu hanya berlaku pada perkara, pelapor dan obyek yang sama,” jelasnya.
Sebelumnya, Ketua Bawaslu Sumenep mengatakan sejak Januari Bawaslu telah memproses sebanyak 243 perkara, termasuk perkara yang berkaitan dengan alat peraga kampanye (APK).
Sementara untuk Pelanggaran Pidana Pemilu, Bawaslu memproses sebanyak 14 perkara. “Rata-rata itu adalah temuan, laporannya sekitar satu kalau tidak salah,” kata Noris saat dikonfirmasi media.
Dari semua perkara Pidana Pemilu lanjut Noris, prosesnya telah selesai dan telah diputuskan untuk dihentikan karena tidak mencukupi alat bukti.
“Kami sudah berupaya untuk meyakinkan Gakkumdu ada unsur Pidana Pemilu. Tapi, selalu mentok di sana (Gakkumdu), setelah rapat digelar selalu tidak bisa dilanjutkan,” ungkap mantan Aktivis Malang itu.
Gakkumdu merupakan gabungan dari 3 lembaga yang menangani dugaan pelanggaran pemilu, diantaranya Bawaslu, Polri dan Kejaksaan. Setiap memproses dugaan pidana pemilu hanya dibatasi 14 hari kerja sejak perkara itu diketahui oleh khalayak umum. (Asm/Red)
