Ditahan, Mantan Ketua DPC PPP Dijerat Pasal Berlapis

Transmadura.com – sumenep – Tersangka kasus dugaan pencemaran nama baik yang telah ditahan Kejari Sumenep, Madura, Jawa Timur, mantan Ketua Dewan Pimpinan Cabang Partai Persatuan Pembangunan (DPC PPP) setempat, KH Baharuddin, dijerat dengan pasal berlapis.

PLH Kasi Intel Kejaksaan Negeri (Kejari) Sumenep, Ridwan Ismawanta, mengatakan, tersangka bisa dikenakan Pasal 27 ayat (3) jo Pasal 45 ayat (1) UU No 11 tahun 2008 tentang informasi dan transaksi elektronik, Pasal 36 ayat (5) jo pasal 57 huruf d UU No 34 th 2002 tentang penyiaran, Pasal 36 ayat (6) jo pasal 37 huruf C UU nomor 32 tahn 2002 tentang penyiaran dan Pasal 310 ayat (1) KUH Pidana tentang pencemaran nama baik.

“Jadi, tersangka dikenakan pasal berlapis sesuai dengan UU,” katanya, saat ditemui di ruang kerjanya, Rabu (2/11/2016).

Menurutnya, kasus tersebut saat ini sudah memasuki tahap dua setelah dinyatakan lengkap (P21) oleh penyidik pidana tertentu (Pidker) Polres Sumenep, pada Agustus 2016, dan baru dilimpahkam ke Jaksa Penuntut Umum (JPU) Kejari setempat, Senin 31 Oktober 2016.

Diperkirakan proses penuntutan membutuhkan waktu selama satu minggu. Setelah dinyatakn lengkap maka Krop Adhyaka akan melimpahkan berkas perkara itu ke Pengadilan Negeri (PN) Sumenep untuk disidangkan.

Guna untuk memudahkan proses tersebut, Kejari melakukan penahanan terhadap KH Baharuddin selaku tersangka dalam kasus tersebut. Saat ini KH Baharuddin ditahan di Rumah Tahanan Kelas IIB Sumenep dengan masa tahanan 20 hari.

“Jadi sekarang kami masih mempersiapkan dakwaan. Pasti kami segera limpahkan ke PN untuk proses hukum selanjutnya,” jelasnya.

Menurutnya, jika dalam persidangan tersangka melanggar Pasal 27 ayat (3) UU ITE akan dijerat dengan Pasal 45 Ayat (1) UU ITE, sanksi pidana penjara maksimum 6 tahun dan/atau denda maksimum 1 milyar rupiah. Namun, kalau yang terbukti melanggar Pasal 310 ayat (1) KUH Pidana tentang pencemaran nama baik, ancaman hukumannya 9 tahun penjara.
