Dengan begitu, negara telah mengakui sejumlah alasan diputusnya kontrak kerja PPPK meski memiliki kinerja baik.
Diketahui, PPPK merupakan ASN yang memiliki masa kerja mengacu pada perjanjian kerja atau kontrak kerja.
Aturan kontrak kerja PPPK sudah diatur Jokowi di dalam PP Nomor 49 Tahun 2018.
Melalui beleid tersebut, PPPK memiliki kontrak kerja paling singkat hanya satu tahun.
Namun, pemerintah berhak untuk memperpanjang kontrak kerja PPPK berdasarkan kebutuhan dan penilaian kinerja.
Kendati demikian, PPPK bisa saja tidak mendapatkan perpanjangan kontrak kerja meskipun memiliki penilaian kinerja yang sangat baik dan masih dibutuhkan oleh instansi.
Bahkan, kontrak kerja PPPK bisa saja diputus secara tiba-tiba oleh pemerintah.
Diantara alasan yang menyebabkan kontrak kerja PPPK diputus atau tidak dapat lagi diperpanjang oleh pemerintah yang telah ditetapkan oleh Jokowi di dalam UU nomor 20 tahun 2023
Disebutkan, sebanyak 9 hal (di luar dari tidak berkinerja) yang mengakibatkan kontrak kerja PPPK diputus atau tidak diperpanjang oleh pemerintah.
Diantara alasannya, yaitu sebagai berikut:
– Mencapai batas usia pensiun
– Terkena perampingan organisasi
– Cacat jasmani dan rohani berakibat tidak dapat bekerja
– Dipidana penjara oleh putusan pengadilan berkekuatan hukum tetap karena tindak pidana berakibat dipenjara paling singkat 2 tahun
– Menyelewengkan UUD 1945 dan Pancasila
– Dipidana penjara oleh putusan pengadilan berkekuatan hukum tetap karena tindak pidana kejahatan jabatan atau yang berhubungan dengan jabatan
– Melakukan pelanggaran disiplin berat.
