SUMENEP, (Transmadura.com) -Terdakwa Hadi Sudirfan, S.Pd.I, selaku Kepala Desa Aengtongtong, Kecamatan Saronggi divonis kurungan selama 7 bulan penjara oleh Pengadilan Negeri (PN) Sumenep, Madura, Jawa Timur, Selasa, (16/8/2022).

Pasalnya, Kades Aengtongtong, terbukti bersalah secara meyakinkan melakukan tindak pidana sebagai mana diatur dan diancam pasal 311 ayat (1) KUHP.

“Ya, hasil putusan PN Sumenep, terdakwah Hadi Sudirfan, S.Pd.I, kades aengtongtong telah divonis bersalah melakukan tindak pidana kurungan penjara selama 7 bulan,” kata Supyadi, SH, Kuasa Hukum Pelapor (Perangkat Desa).

Menurutnya, atas putusan ini, pihaknya menyatakan sudah jelas membuktikan bahwa tuduhan Kades Aengtongtong yang memberhentikan pelapor sebagai perangkat desa, dianggap meresahkan masyarakat dan tidak terbukti.

“Hasil Putusan dari Pengadilan Negeri Sumenep dengan Nomor : 40/Pid.B/2022/PN Smp,” jelasnya.

Namun, lanjut Supyadi, terhadap putusan tersebut, masih ada kesempatan kepada terdakwa 14 hari untuk menerima putusan atau mengajukan upaya hukum banding ke Pengadilan Tinggi Jawa Timur.

“Terdakwa masih diberi kesempatan untuk menerima atau tidak selama 14 hari,” ungkapnya.

Sebelumnya diberitakan, cerita peristiwa awal terdakwa kades aengtongtong, Hadi Sudirfan, S.Pd.I
berawal pada Senin, (9/3/2020), sekira pukul 16:00 wib pada suatu tempat lain diwilayah pengadilan negeri Sumenep memeriksa dan mengadili.

Mereka kades Aengtongtong diduga melakukan kejahatan pencemaran atau pencemaran secara tertulis surat peringatan I pada masing masing perangkat desa tembusanPutusan PN, Kades Aeng TongTong Divonis Bersalah Penjara 7 Bulan surat peringatan I kepada ketua BPD setempat.

Selanjutnya pada Kamis, (12/3/2022) terdakwa membuat Surat Peringatan II terhadap perangkat desa tersebut yang berisi bahwa tidak melakukan klarifikasi tindak lanjut terhadap Surat Peringatan I dan pemberhentian sementara.

“terdakwa mengirim Surat Peringatan II pada masing-masing perangkat desa dan menembuskan Surat Peringatan II kepada Ketua BPD desa aengtongtong, dibolehkan untuk membuktikan apa yang dituduhkan itu benar,” ujar Supyadi, SH.

Surat kedua dari terdakwa, kata pria asal kepulauan ini, untuk membuktikan dan tidak
membuktikannya dan tuduhan dilakukan bertentangan dengan apa yang diketahui, maka dia diancam melakukan fitnah, perbuatan oleh terdakwa dilakukan dengan cara-cara sebagai berikut :

Bahwa berawal pada hari Senin tanggal 9 Maret 2020 sekira pukul 16.00 Wib, saksi HENDRIK JATMIKO WINANDY, SE menerima surat peringatan I Nomor : 188/SP/435.307.112/2020, tertanggal 9 Maret 2020 yang ditanda tangani oleh terdakwa HADI SUDIRFAN, S.Pd.I

Menuduh saksi HENDRIK JATMIKO WINANDY, SE telah melanggar larangan sebagai perangkat desa dan melakukan tindakan yang meresahkan sekelompok masyarakat, ditembuskan kepada Ketua BPD Aengtongtong serta kepada Camat Saronggi.

Kemudian terdakwa HADI SUDIRFAN, S.Pd.I mengirim surat peringatan II Nomor : 188/SP/435.307.112/2020, tertanggal 12 Maret 2020 yang ditanda tangani oleh terdakwa yang intinya sama dengan surat yang pertama.

Saksi HENDRIK JATMIKO WINANDY, SE (pelapor) mengkonfirmasi kepada terdakwa HADI SUDIRFAN, S.Pd.I, tentang surat yang terdakwa kirimkan kepada saksi HENDRIK JATMIKO WINANDY, SE, bahwa tuduhan tersebut tidak sesuai fakta. karena pelapor tidak pernah melanggar sewaktu menjabat sebagai Sekdes dan tidak pernah melakukan tindakan yang meresahkan masyarakat.

Namun, maksud dan tujuan terdakwa mengirim surat tersebut, karena Saksi Hendrik Jatmiko Winandi akan diberhentikan sebagai sekdes Aeng tongtong dan akan diganti sekdes yang lain.

Sehingga, Sekdes Hendrik Jatmiko (Pelapor) merasa nama baik tercemar dan malu kepada masyarakat yang diberhentikan dengan alasan tidak jelas.
