Tes calon Komisioner Informasi (KI) Kabupaten Sumenep, Madura, Jawa Timur, dalam pelaksanaan Fit And Proper Test yang diduga cacat hukum perlahan mulai akan terbongkar. Hal ini mencuat yang sempat diadukan ke KI Provinsi Jatwa Timur, oleh Herman Wahyudi, warga Karanganyar, Kecamatan Kalianget tahun lalu.
Dalam aduan tersebut, pihak pelapor salah satunya meminta nilai hasil uji kelayakan dan kepatutan oleh komisi bidang hukum dan pemerintahan itu, dan video pelaksanaan.
Namun, sampai kasus ini tuntas data yang diminta tidak dipenuhi. Terlapor dalam hal ini DPRD hanya menunjukkan hasil voting di internal komisi.
Padahal, dalam surat putusan media KI Jatim nomor 61/V/KI.Prov.Jatim.Ps-A-M/2018, di mana dalam putusan itu memerintah keduanya untuk memenuhi kewajibannya.
Terlapor memenuhi permintaan nilai hasil uji kelayakan dan video. “Namun, tidak ada nilai yang diberikan apalagi ditunjukkan kepada kami, termasuk video juga tidak diberikan,”kata pelapor Herman Wahyudi.
Menurutnya, sambung dia, pihaknya akan diberikan daftar hasil voting dan contreng pemilihan di komisi pimpinan Hamid Ali Munir ini. “Saya saat melapor hanya meminta nilai dan video. Namun, tidak ada nilai yang ditunjukkan. Jadi, sangat aneh,” ujarnya kepada media ini.
Warga Karanganyar, Kalianget ini mengungkapkan pelaksanaan proses rekruitmen ini memang bermasalah. Sehingga, wajar jika banyak pihak mempertanyakan adanya kejanggalam dalam rekruitmen ini. “Ya, jika tidak ada nilai maka jelas ini melanggar Perki nomor 4, di mana Fit and proper tes itu harus ada nilai,” ucapnya.
Bagaimana dengan nilai yang muncul belakangan?, Pihaknya menduga jika nilai muncul setelah gugatan ke KI. Sebab, saat sidang tidak pernah ada nilai ditunjukkan. “Ya, kami menduga ini jelas sebuah pelanggaran dan cacat hukum dalam prosesnya,” tuturnya.
Kuasa Hukum Ketua DPRD Sumenep Ach Novel membenarkan jika permintaan nilai tidak dipenuhi saat sidang sengketa informasi di KI. Jika tidak ada nilai, maka itu melanggar Perki. “Terungkap, proses fit and proper tes ini memang tidak sesuai Perki nomor 4. Ada aturan yang dilabrak,” ucapnya.
Menurutnya, pelaksanaan fit and proper tes itu harus menjadi catatan serius, biar dalam pelaksanaanya maksimal. Bahkan, pihaknya mengusulkan uji kelayakan itu dilakukan oleh orang profesional, semisal perguruan tinggi. “Sehingga, hasilnya kualified,” tukasnya.
