UU Desa Terbaru, Kepala Desa Dapat Tunjangan Uang Pensiun?

NUSANTARA, (Transmadura.com) – Presiden Joko Widodo atau Jokowi mengesahkan Undang-Undang Nomor 3 Tahun 2024 tentang Desa atau UU Desa. Dalam UU Desa yang baru, kepala desa akan mendapatkan tunjangan purna tugas atau uang pensiun.

Tunjangan pensiun itu diatur dalam Pasal 26 ayat 3 UU Desa. Beleid itu menyatakan uang pensiun sebagai salah satu hak kepala desa.

Akan tetapi, besaran tunjangan tersebut tidak ditentukan dalam UU Desa. Menurut aturan tersebut, besaran uang pensiun kepala desa akan menyesuaikan dengan kondisi keuangan desa.

“Mendapatkan tunjangan purna tugas satu kali di akhir masa jabatan sesuai kemampuan keuangan desa yang diatur dalam Peraturan Pemerintah,” seperti tertulis dalam pasal tersebut, seperti dikutip Media Tempo.co pada Kamis, 2 Mei 2024.

Menurut UU tersebut, tunjangan pensiun adalah penerimaan yang sah bagi kepala desa sebagai penghargaan bagi pejabat yang telah purna menjalankan jabatannya. Tunjangan tersebut diberikan dalam bentuk uang atau yang setara dengan itu.

Selain hak mendapatkan tunjangan, Pasal 26 ayat 3 UU Desa mengatur bahwa kepala desa berhak menerima penghasilan setiap bulan, tunjangan, dan penerimaan lainnya yang sah. Kepa desa juga berhak mendapat jaminan sosial di bidang kesehatan dan ketenagakerjaan.

Selain kepala desa, tunjangan purnatugas berhak diberikan kepada pejabat-pejabat desa lainnya. Di antaranya perangkat desa dan anggota Badan Permusyawaratan Desa.

Sebelumnya, DPR RI mengesahkan revisi UU Desa dalam rapat paripurna pada Kamis, 28 Maret 2024. Pembahasan revisi tersebut dilakukan DPR bersama pemerintah.

Selain mengatur uang pensiun kepala desa, beberapa pasal UU Desa diubah, seperti pasal 56. “Anggota Badan Permusyawaratan Desa merupakan wakil dari penduduk Desa berdasarkan keterwakilan wilayah yang pengisiannya dilakukan secara demokratis dengan memperhatikan 30 persen keterwakilan perempuan,” demikian tertulis pada Pasal 56 ayat 1.

Selain itu, terdapat beberapa pasal baru yang disisipkan, seperti Pasal 5 dan Pasal 6, yakni Pasal 5A di mana Desa yang berada di kawasan suaka alam, kawasan pelestarian alam, hutan produksi, dan kebun produksi berhak mendapatkan dana konservasi dan/atau dana rehabilitasi berdasarkan ketentuan peraturan perundang-undangan.
