Sidang Sengketa Tanah, Kades Ketapang Barat Serahkan Bukti Surat Tanah di PN, Penggugat Optimis

SAMPANG, (TransMadura.com) – Sidang kasus sengketa tanah di Pengadilan Negeri (PN) Sampang, Madura, Jawa Timur, sampai pada penyerahan bukti surat dari tergugat 3, yakni pihak Desa, di Pengadilan Negeri (PN) Sampang, Madura, Jawa Timur, selasa (20/10/2020).

Supatmi, sebagai penggugat warga Desa Ketapang Barat, mengklaim bahwa tanah tersebut adalah milihnya sesuai letter c desa, yang diduga diserobot oleh tergugat 1 bernama H Faris, yang saat ini sudah terbit setifikat.

Ketua majelis hakim Aprisalesa MH, mengakatakan, sidang kasus sengkata tanah saat ini penyerahan bukti surat sebanyak tiga. “Ini sudah sidang kesekian kalinya, sudah sampai pada sidang penyerahan bukti surat dari tergugat,” katanya

Namun, karena penggugat dan tergugat sudah menunjukkan bukti bukti surat, selanjutnya dilakukan penawaran kepada kedua pihak sepakat untuk gelar periksa ke tempat objek sengketa. “Kami tawarkan itu sepakat untuk di lakukan gelar periksa objek,” ungkapnya.

“Sidang kami tunda untuk dibuka kembali pada tanggal 23 oktober 2020 jam 10 kita buka kembali,” ungkapnya.

Kuasa Hukum penggugat, Moh Taufik MD, S.I.kom., S.H. M.H. menyampaikan, sidang kali ini penyerahan bukti surat dari tergugat 3, yakni pihak kades.

“Di Petok Letter C atau buku desa memang ada fakta fakta. Saya meyakini yang benar, bahwa itu hak klien kami. Sehingga majelis hakim tetap objektif menilai tentang itu,” ucapnya.

Sebagai kuasa penggugat, dia beharap majelis yang memeriksa dan menangani perkara itu, dan sebagai ketua pengadilan Faizal dalam perkara ini agar dimenangkan dirinya. “Perkara ini sudah bertahun tahun dan bukti bukti sudah jelas di petok desa, meminta hak kami,” harapnya.

Sehingga, lanjut taufik, sebelumnya sudah jelas, mengingatkan kepada tergugat, bahwa jangan beli tanah di lokasi itu, karena itu bukan haknya. “Tapi tetap saja membeli kepada oknum yang mengaku bahwa tanah itu milik dia,” ujarnya.

Hal itu terbukti ada dugaan pemalsuan surat, setelah dirinya melakukan konfirmasi ke pemerintah desa, bahwa mengaku pemdes tidak pernah menandatangani berkas tersebut.

“Saya konfirmasi ke pemerintah desa tidak ada tanda tangan dari pemerintah desa,” ungkapnya.

Sehingga, pihaknya meminta pengadilan sampang, untuk mendalami kasus ini dan menduga ada sesuatu yang janggal dalam proses penerbitan sertifikat.

“Dalam petok itu kan masih resmi, juga kami ada kata kunci dari tergugat tiga yang diwakili kepala desa, tidak ada perubahan atas tanah itu, bahkan pihak desa tidak pernah tandatangan dalam proses sertifikat, dan kita sudah tau kalau di warka ada surat sporadik dan surat keterangan riwayat tanah,” tegasnya.
