SUMENEP, (TransMadura.com) -Kepala Desa Tanjung, Sumenep, Madura, Jawa Timur menyatakan Letter C bukti kepemilikan sah. Sebab, selama ini lahan yang dikuasai PT Inti Bhakti Rahayu Abadi (IBRA) diklim miliknya.

Namun, Kades berani tantang untuk membuktikan kepemilikan lahan lokasi pengeboran Sumur ENC 2 di desa tersebut.

“Letter C merupakan bukti kepemilikan yang saha dan valid. Dan semua itu mengacu kepada letter. Jadi, kepemilikan di letter C itu tetap atas nama pemilik lahan warga, bukan perusahaan, ” kata Kades Tanjung, Salamet.

Pernyataan itu menyusul sengketa lahan antara ahli waris dengan perusahaan yang mengusai lahan ekplorasi migas itu. Bahkan, kasus ini sudah menggelinding ke Mapolres Polres Sumenep. Sementara desa mengklaim jika lahan itu belum ada pembebasan dari ahli waris sebagaimana termaktub dalam buku C.

Letter C untuk lokasi pengeboran minyak dan gas (migas) oleh KKKS PT EML dibuat pada tahun 1956, sementara untuk buku rincikan dibuat pada tahun 1946. “Jadi, desa itu mengusai data absah dan akurat, ” ujar pria santai ini.

Kades Salamet menyampaikan, Letter C itu dianggap sah apabila belum dokumen kepemilikan diatasnya. Misalnya, akta jual beli lahan dan juga sertifikat. “Sampai detik ini, kami yakin perusahaan belum memiliki ini. Jadi, letter C masih sah dan cukup kuat bukti kepemilikan,” tuturnya.

Hal itu juga terlihat, jika pengusahaan lahan oleh dua perusahaan sebelumnya yakni PDA Jasa Permes dan CV Mahera sudah tuntas dengan munculnya akta pengakhiran konsorsium di 2013. Namun, dalam pasal 6 akta tersebut seharusnya ada pembebasan lahan tersebut.

“Ternyata sampai detik ini tidak ada. Sehingga, yang menyebabkan polemik yang berkepanjangan. Bahkan, SPPT kabarnya masih PDA Jasa Permis. Berarti kan belum ada peralihan penguasaan lahan. Dan, harusnya pelepasan dulu sesuai akta, ” ucapnya.

Untuk itu, pihaknya berharap ada penyelesaian yang tepat dan terarah. Sehingga, sama-sama tidak ada yang dirugikan. “Hendaknya diselesaikan secara baik. Kami mendukung ekplorasi migas di Tanjung, tapi prosesnya juga harus diperhatikan, ” ungkapnya.

Sebelumnya, Public Relation Coordinator EML Nur Hidayat mengklaim lahan tersebut sudah klir dan clean. Sebab, Sejak awal perjanjian sewa lahan yang juga ditandatangani Kades Salamet pada 2012, nama pihak-pihak yang disebut ada di dokumen Letter C itu sudah tidak ada dalam catatan BPN. Dan Pak Kades Salamet ikut tanda tangan dalam dokumen BPN tersebut.

Menurutnya, pihak M. Andi Suryanto yang mengklaim masih mempunyai hak atas tanah tersebut, sebenarnya sudah dipersilahkan menempuh jalur hukum dengan melaporkan perusahaan ke polisi sejak 3 Juli 2018 lalu. Tapi sampai hari ini tidak ada laporan masuk ke Polres Sumenep.

“PT IBRA sudah menunggu sebulan, tapi mereka tidak membuat laporan ke kepolisian. Lha kok malah Pak Kades lapor wartawan. Jadi ini sebenarnya siapa memainkan lakon apa?” ujarnya dengan nada keheranan. (Asm/Red)
