Kepala Desa/Kecamatan Guluk -Guluk, Sumenep, Madura, Jawa Timur, PAW terpilih akan di PTUNkan terkait pemberhentian pengangkatan Kepala Dusun (Kadus), disinyalir sarat rekayasa.
Kadus merasa dilecehkan haknya oleh Kepala Desa, karena tidak prosedural pemecatan dan pengangkatan yang mana dalam masa berlakunya SK masih 5 tahun lagi.
Hal ini disampaikan Gerakan Forum Peduli Masyarakat (FPM) Sumenep Bambang Supratman selaku kuasa Pendampingan dari Kadus, Pemecatan dan pengangkatan kadus Desa Guluk-Guluk, diduga melanggar yang sudah jelas diatur Kemendagri nomor 83 tahun 2015 dan di perbaharui dengan peraturan Mendagri no 67 tahun 2017.
“Pembehentian pengangkatan perangkat desa harus memenuhi dua unsur mekanisme sesuai aturan mendagri paling tidaknya harus konsultasi dengan Camat setempat,” Kata Gerakan Forum Peduli Masyarakat Bambang Supratman.
Menurutnya, mereka meminta penegak Perda dan OPD terkait untuk memberi sangsi sesuai UU pasal 29 dan pasal 30 terhadap Kades PAW, persolan menyangkut perangkat desa.
“Kami akan bawa persoalan ini ke Pengadilan Tata Usaha Negara (PTUN), yang mana pemberhetian dan pengangkatan banyak direkayasa, baik ijazah maupun juga nama,” ungkapnya.
Bahkan, Kades PAW terpilih Desa Guluk-Guluk, yang semena -mena tidak prosedural menyalahi aturan yang sudah diatur dalam undang-undang.
“Kades semena – mena memecat perangkat yang menyalahi aturan, ini harus di pertanggungjawabkan, karena kadus dan dua kaur merasa haknya dilecehkan oleh kades,” tandasnya.
Sementara, Kepala Desa PAW Guluk – Guluk Moh.Wail mengaku tidak pernah memberhentikan dan Pengangkatan perangkat Desa.
“Itu kata siapa kalau saya mecat dan mengangkat perangkat. Sampai saat ini saya tidak pernah mecat kadus. Kadus yang mana,” ungkapnya dengan singkat.
